cITY OF Sparks APPROVED BILLS EFFECTING REDEVELOPMEnt plans

April 27, 2026

On April 27, 2026, the Sparks City Council approved a bill (ordinance) amending the Sparks Municipal Code on Fire Prevention and Protection. This adopted the 2024 International Fire Code (and related appendices), the 2024 International Wildland-Urban Interface Code (IWUIC), and other related fire protection codes and amendments, effective the same day.

This is no longer a prospective change; it is the law in Sparks as of April 27, 2026. This development provides legal framework to address fire prevention concerns regarding the Red Hawk project.


Why This Could Present Some Challenges for Red Hawk

The 2024 IWUIC introduces more stringent defensible space and fuel modification requirements that the developer must reconcile with their high-density site plan:

  • The 30/100 Foot Mandate: The code requires a minimum 30-foot fuel modification zone, extending to 100 feet in high-hazard areas. Given Red Hawk’s proximity to the canyon and high-desert vegetation, the 100-foot requirement will likely apply, and may affect the "buildable" footprint of their proposed lots.
  • The 5-Foot Non-Combustible Buffer: The new code emphasizes a "Zone 0" (the first 5 feet from any structure) that must be entirely free of combustible materials (bark, mulch, or woody shrubs). This may also be difficult to achieve with the developer’s current narrow lot setbacks.
  • Vegetation Spacing Standards: The code now mandates a 10-foot horizontal separation between tree crowns and a 6-foot vertical clearance from the ground. This prevents "ladder fuels" but also limits the dense landscaping often used to mask high-density builds.
  • Perpetual Maintenance: Crucially, the 2024 code mandates that this defensible space be maintained for the life of the structure. This may raise questions about the long-term financial responsibility for a future HOA—a point we know the Wingfield Springs community is sensitive to.
